Is it legal to file chapter 7 bankruptcy just so you don’t have to payout in a lawsuit?
My husband and I filed a lawsuit against an individual over a year ago. We’re a week out from the deposition and he just filed a lawsuit. He claims he had to do it because of the lawsuit but he doesn’t even know the monetary amount we’re suing him for at this point. How is that possible?
I intended to type . . . he just filed for bankruptcy, not a lawsuit.

Yes, but when you do you will be putting yourself in the hands of a judge who will decide what you owe and who you owe it to.

You can’t file for bankruptcy to avoid paying a lawsuit. You can file for bankruptcy if the lawsuit puts yourself in over your head. That means you will be screwing all your other creditors also. But figure on most of your liquid assets being gone in the process.
