Please Serious answers. I been a Legal resident for 6 years, but I am in the humiliating process of the bankruptcy , thanks a lot

I don’t know why it would be a problem other than the fact it would make it more difficult to pay the fees. It’s not a crime in any sense and they don’t do credit checks to determine whether you are qualified or not.

My grandparents filed chapter 13 bankruptcy in September 2009, their trucks were towed tonight. Is this legal?

In the bankruptcy the trucks were included. The bank that repo’d their vehicles was put in contact with their attorney and informed of the bankruptcy. I can’t find anything on the internet about this happening to anyone else, all I can find is that chapter 13 can stop a reposession. Does anyone know if this is legal?

Bankruptcy can stop a repossession IF the judge rules in favor of the bankruptcy AND includes the car as a protected asset. Simply FILING, however, does not grant protection. The repo guys beat you to the punch.

Can the "Legal fees tax credit" be used for any type of criminal offense or a bankruptcy?

I see there is a legal fees tax credit as i was fillling out my h&r block taxes so does this apply to any criminal offense or bankruptcy?
i dont have a criminal offense but did a bankruptcy…

What "Legal fees tax credit?" There’s no such animal.

There is a 2% miscellaneous itemized deduction for legal fees. A deduction is not the same thing as a tax credit! The deduction for legal fees is only for the preparation of tax returns or for legal advice related to the production of taxable income. Legal fees for criminal defense, bankruptcy, or any other purpose are not deductible.

Do the legal fees of bankruptcy cost differently depending on the amount being filed?

I may have to file bankruptcy in the future. Do the legal fees vary depending on the amount being filed in the bankruptcy? For example: If I have $10,000 in debt would the fee for bankruptcy be different than if I have $200,000 in debt or is it a standard bankruptcy charge? Thank you in advance for your help.

If you do have to file for bankruptcy you will have to pay the court costs. If , at the time you file , your annual earnings are more than £14,600 you will have to pay the full fees , which are £485.
If you earn less than £14,600 the courts will reduce the fees to £385.

To apply for bankruptcy you need to complete 2 forms, numbers 6.27 and 6.28 which you can get from your local county court or search here

I started the bankruptcy process and I have not finished paying it off yet. I advised a collector I have filed bankruptcy. And they continue to calls all day everyday 7 days a week. Is this a legal issue?

The creditor’s actions are a violation of the automatic stay. Hire a local bankruptcy attorney and file a motion for sanctions against the collector.

i want to file for bankruptcy, but before i do that i was wondering if it’s legal to purchase certain things with my credit card. For example, i want to buy an Xbox 360 and some games for my children, a camera, an I touch, and some clothes for my daughter with credit card. And after i purchase those items, i would file for bankruptcy. is that legal or illegal?

It depends on the circumstances.

If your up to date on your bills and charge these things and then change jobs and take a pay cut your fine because you can claim the pay cut was unexpected.

On the other hand if you are behind or anything and don’t change jobs and take a pay cut it will be considered fraud.

is there any legal restrictions on "last minute debt" which is not dischargeable by bankruptcy?

it seems to me that if a person knew they were going to have to file bankruptcy, a decision which isn’t made overnight, they could conceivably intentionally overdraft their bank account, take out payday loans, etc, seemingly without consequence…

is there in legal protection against this sort of thing?

(save the opinions about the ethics of this sort of thing, I need a factual legal answer)

That would be bankruptcy fraud. It would be instantly detected and the perpetrator would end up in federal prison.
