Can legal aid help with bankruptcy?

Wednesday, January 26th, 2011

Can they help by providing a bankruptcy lawyer.

Understand something. Legal aid in the US is virtually non-existant. They have practically no funding. They choose the cased they take very, very carefully and they tend to take cases that are heartbreakers where someone is getting screwed over for lack of a lawyer. It is highly doubtful that they would even consider a personal bankruptcy case.

anyone can give legal advice regarding bankruptcy?

Thursday, December 16th, 2010

My wife filed a bankruptcy in the middle of the divorce. My lawyer asked to file a proof of claim for the community property. What is the best action I should take?

Yes — your lawyer can give you legal advice. People who are not lawyers are not good sources of legal advice. Websites are not good sources of legal advice either. And lawyers who contribute to websites are prohibited from giving legal advice on the website. They must establish an attorney-client relationship before giving legal advice, and they cannot do that on a website.

So talk to your own attorney in person. That is the best source of legal advice regarding bankruptcy.

can legal aid help me pay to file bankruptcy?

Saturday, December 11th, 2010

I am needing to file for bankruptcy and I am paying for half from my tax returns. I have no money coming other than that. Do you think legal aid could help and if not does anyone know something that might be able to help? Thank you :)
no legal aid will not pay for bankruptcy - there are no financial organisation or benefit support to help you pay for bankruptcy , you have to pay for it yourself - i think its about £590 now and has to be paid in cash by you.. the only help you can get would be for someone u know to lend it to you

are there any legal options when a bankruptcy with confirmation is dismissed?

Saturday, October 9th, 2010

No. Once the bankruptcy is dismissed the case is over.

You can talk to your bankruptcy attorney about the possibility of filing a new bankruptcy case. This will cost you the same amount as it cost you to file the one that was dismissed. You will be starting all over again.

Legal Seperation; Filing for Bankruptcy Together?

Thursday, September 30th, 2010

My husband and I will be filing for legal seperation soon. We also believe it is in our best interest to file for bankruptcy. If we are legally seperated, can we still file bankruptcy together? We have aquired the majority of our debts together so we think it makes the most sence to do this together (we are better friends than spouces). Does anyone know if we can file together if we are legally seperated, or in the process of legal separation?

Yes you can file jointly. Only requirement is that you are married. You may have to jump through some hoops to show that you are two household thus qualifying you for chapter 7 or making a payment lower under chapter 13.

Curious as to what state you are in that recognizes a legal form of separation and not divorce?

What are some of the legal issues in declaring bankruptcy?

Friday, August 20th, 2010

Bankruptcy laws were put into effect to help people or organizations overburdened by debt. The idea is that, by declaring bankruptcy, the debtor receives a new start when the debt-burden is relieved, and an opportunity to repay creditors (to the extent possible).

Many people in today’s world find themselves overwhelmed by combined debt, accumulated through student loans, credit card debt, mortgages and the like. When no other option seems possible, bankruptcy may offer the only way back to a healthy financial situation.

My fiance has filed bankruptcy and her home maybe foreclosed upon. What are the legal consequences?

My fiance has filed bankruptcy and her home may be foreclosed upon. What are the legal consequences to me?

None as long as you do not have any joint accounts. Keep all finances separate from hers even upon marriage. No joint bank accounts, no joint charge cards and always file income taxes as Married but filing separate.

Is it legal to sell a car you filed bankruptcy on?

Wednesday, August 11th, 2010

I’m purchasing a vehicle from someone who bought it on their credit card. I have the title and the car is registered in my name. I have since found out that they have filed bankruptcy on that card but they are still having me make the same payment. I want to know if I’m financially responsible for continuing to pay on the car after they wrote the card off?

If you have the title in your name the car is yours. You own it legally.

If you made a contract with a friend (verbal or written) to pay for the car you are still 100% obligated to pay back the debt to your friend. His bankruptcy doesn’t affect the arrangement you made with him.

If you owe him money you need to pay it back. All of it.
